Terms and Conditions (T&C)

Hereinafter referred to as “Amsterdamhost”.
§ 1 Scope and General Provisions
- These Terms and Conditions govern all contractual relationships between customers and Alpenhost e.U. operating under the brand Amsterdamhost.nl.
- Amsterdamhost.nl is not an independent legal entity. The contractual partner is exclusively Alpenhost e.U., Austria.
- Deviating terms of the customer shall not apply unless expressly agreed in writing.
- The contractual relationship is governed by the laws of the Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- For consumers within the EU, mandatory consumer protection laws of the country of residence remain unaffected.
- Place of jurisdiction for business customers is Vienna, Austria.
- Contract language is English.
- Where personal data is processed, the Datenschutz-Grundverordnung (GDPR) applies. A Data Processing Agreement (DPA) forms an integral part of these terms where required.
- Consumers may use the EU Online Dispute Resolution platform:

§ 2 Services Provided
Amsterdamhost provides, via www.amsterdamhost.nl:
- Web hosting services
- E-mail hosting
- Virtual and dedicated server services
- Domain registration and management
- Optional IT and support services
Technical support is not included unless explicitly agreed.
§ 3 Service Availability and Backups
- Storage space is provided on virtualized or physical servers operated or rented by Alpenhost e.U.
- Daily backups may be performed. No guarantee is given for successful restoration.
- Access is provided via control panel, FTP, SSH or similar technologies.
- Due to the nature of the internet, 100% availability cannot be guaranteed.
- Maintenance windows do not constitute service failure.
§ 4 Domain Registration
- Domain registrations are carried out via authorized registrars such as:
- SIDN (.nl)
- DENIC (.de)
- Relevant international registries
- Amsterdamhost acts solely as an intermediary.
- The customer warrants that domains do not infringe third-party rights.
§ 5 Conclusion of Contract
A contract is concluded upon acceptance of an online order or written offer confirmation by Amsterdamhost.
§ 6 Payment Terms
- Billing occurs at least quarterly, domains annually
- Payment due within 10 days
- Prepayment via bank transfer or PayPal
- Prices include applicable VAT
- Services may be suspended in case of payment default
§ 7 Contract Duration and Termination
- Minimum term: 1 month (domains: 1 year)
- Notice period: 30 days to month-end
- Data will be deleted 4 weeks after contract termination
- Customer is responsible for backups and migration
§ 8 Customer Obligations
The customer must not:
- Send spam or mass mailings
- Host unlawful content
- Overload systems intentionally
- Violate data protection laws
The customer is responsible for regular data backups and securing access credentials.
§ 9 Suspension of Services
Amsterdamhost may suspend services or content if there is reasonable suspicion of illegal activity or legal violations.
§ 10 Liability
- Unlimited liability for intent and gross negligence.
- For slight negligence, liability is limited to foreseeable contractual damages.
- No liability for data loss unless a paid backup service agreement exists.
§ 11 Data Protection
Personal data is processed in accordance with GDPR. A Data Processing Agreement is provided where necessary.
§ 12 Amendments to these Terms
Amsterdamhost may amend these Terms with 14 days’ notice via email.
Right of Withdrawal (Consumers)
Consumers have the right to withdraw from the contract within 14 days in accordance with EU distance selling regulations.
The right of withdrawal expires if the service has been fully performed after explicit consent by the customer.
